SolanaMemeBotTrader provides an automated trading bot that executes trades on meme coins on the Solana blockchain through the pump.fun platform. The Trading Bot operates based on:

• Parameters and settings configured by you
• Market conditions and data available at the time of trading

5.2 Service Limitations

You acknowledge and agree that:

• Our Services are provided on an "as is" and "as available" basis
• The Trading Bot's performance depends on various factors, including market conditions, network congestion, and third-party platform functionality
• We do not guarantee the availability, reliability, or performance of the Trading Bot at all times
• We may modify, suspend, or discontinue any aspect of our Services at any time
• We are not responsible for the actions, content, or policies of third-party platforms, including pump.fun

5.3 No Investment Advice

Our Services do not constitute financial, investment, legal, or tax advice. The Trading Bot is a tool for executing trades based on parameters you set, not a recommendation to buy or sell any specific cryptocurrency.

6.1 Subscription Plans

We offer various subscription plans for access to our Services. The features, limitations, and pricing of each plan are described on our website. We reserve the right to modify our subscription plans and pricing at any time.

6.2 Payment Methods

We accept payment in various cryptocurrencies and fiat currencies through our supported payment processors. By providing payment information, you represent and warrant that:

• You are authorized to use the payment method provided
• The payment information you provide is accurate and complete
• You will update your payment information as necessary

6.3 Automatic Renewal

Subscription plans automatically renew at the end of each billing period unless canceled before the renewal date. You authorize us to charge your payment method for the renewal at the then-current rate.

6.4 Refunds

6.5 Trading Fees

• Any pending trades may be canceled
• You will not be entitled to a refund of any fees already paid

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY.

WITHOUT LIMITING THE FOREGOING, WE EXPLICITLY DISCLAIM ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, QUIET ENJOYMENT, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE.

WE MAKE NO WARRANTY THAT:

• THE SERVICES WILL MEET YOUR REQUIREMENTS OR BE AVAILABLE ON AN UNINTERRUPTED, SECURE, OR ERROR-FREE BASIS
• THE TRADING BOT WILL GENERATE PROFITS OR PREVENT LOSSES
• THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SERVICES WILL BE ACCURATE OR RELIABLE
• THE QUALITY OF ANY PRODUCTS, SERVICES, INFORMATION, OR OTHER MATERIAL PURCHASED OR OBTAINED BY YOU THROUGH THE SERVICES WILL MEET YOUR EXPECTATIONS

YOU ASSUME ALL RISKS ASSOCIATED WITH USING OUR SERVICES, INCLUDING THE RISK OF FINANCIAL LOSS.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL SOLANAMEMEBOTTRADER, ITS AFFILIATES, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, THAT RESULT FROM THE USE OF, OR INABILITY TO USE, THE SERVICES.

IN NO EVENT SHALL OUR AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICES EXCEED THE GREATER OF:

• THE AMOUNT PAID BY YOU TO US FOR THE SERVICES IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO THE LIABILITY, OR
• $100 USD

THE LIMITATIONS OF LIABILITY IN THIS SECTION SHALL APPLY TO ALL THEORIES OF LIABILITY, WHETHER BASED ON WARRANTY, CONTRACT, STATUTE, TORT (INCLUDING NEGLIGENCE), OR OTHERWISE.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO SOME OR ALL OF THE EXCLUSIONS AND LIMITATIONS IN THIS SECTION MAY NOT APPLY TO YOU.

You agree to indemnify, defend, and hold harmless SolanaMemeBotTrader, its affiliates, officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) that arise from or relate to:

• Your use of or access to our Services
• Your violation of these Terms
• Your violation of any rights of another person or entity
• Your User Content
• Your trading activities or decisions

We reserve the right, at your expense, to assume the exclusive defense and control of any matter for which you are required to indemnify us, and you agree to cooperate with our defense of these claims.

15.1 Governing Law

These Terms and your use of the Services shall be governed by and construed in accordance with the laws of the State of Delaware, without giving effect to any choice or conflict of law provision or rule.

15.2 Dispute Resolution

Any dispute, controversy, or claim arising out of or relating to these Terms or the Services shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall be conducted in English and shall take place in San Francisco, California.

15.3 Class Action Waiver

YOU AND SOLANAMEMEBOTTRADER AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

15.4 Time Limitation

You agree that any claim arising out of or related to these Terms or our Services must be filed within one (1) year after such claim arose, otherwise, the claim is permanently barred.

We may modify these Terms at any time by posting the revised Terms on our website or by notifying you through the Services. Your continued use of the Services after the effective date of the revised Terms constitutes your acceptance of the changes.

It is your responsibility to check these Terms periodically for changes. If you do not agree to the modified Terms, you should discontinue your use of the Services.
